Rental Terms, Conditions & Indemnity
At Dare to Live Motorcycle Adventures, we value your safety and experience. To ensure a smooth and enjoyable process for everyone involved, we’ve outlined the following terms and conditions. By agreeing to these, we establish a clear understanding and can focus on the adventure ahead!
These terms and conditions apply to all rentals and combo packages offered by or booked with Dare to Live Motorcycle Adventures. By accepting them, you also agree that any legal disputes will be governed exclusively under the jurisdiction of South African law. Riders must comply with the laws, customs, foreign exchange, and other regulations of the country they visit.
The hirer must be in possession of a valid motorcycle license, acceptable by South African authorities, for the duration of the rental period. Please carry your license at all times.
Damages Deposits (Excess)
- Refundable in 7 working days after full clean and inspection on motorcycle hire.
- Please note that our rates include comprehensive motorcycle and 3rd party insurance — but the rider will be liable for ZAR10,000 per bike (we hold a Damages deposit on your credit card for the duration of the rental period) in the unlikely event of an accident.
- All minor damages under ZAR10,000 will be paid for by the renter.
- Damages deposits can be paid in CASH or with credit cards, but no DEBIT cards.
- Full or partial refunds will be done on full inspection of the motorcycle by an appointed person or the Operator.
- Rental Fleet suppliers/Operators and manager have full discretion to repair or replace parts damaged. Customers have no rights to collect or demand damaged parts from any accident.
- The motorcycle must be parked off-street overnight for theft under Dare to Live Motorcycle Adventures‘ Fully Comprehensive Insurance Coverage.
- A police case number is required should the hirer require Dare to Live Motorcycle Adventures to claim from insurance. The hirer will be liable for the complete loss should a police case number not be reported correctly or the case number not supplied.
License and Travel Documents
- All riders must possess a valid motorcycle license. If your license is not in English, you must also provide an international driver’s license. Licenses must be presented prior to receiving the motorcycle.
- Riders must be at least 25 years old. Special arrangements for younger riders can be made upon request—please contact us directly. An additional R5000 excess insurance will be charged for riders under 25.
- A valid credit card must be presented prior to motorcycle handover. The insurance excess for the motorcycle will be reserved on the credit card. At the end of the rental period, this reservation will be lifted unless damages occurred. If damages arise, the cost will be deducted, and the rider will be informed.
- Riders are responsible for ensuring they have all necessary legal documents, such as passports, visas, and health certificates, for all countries visited.
Daily Rental Charges and Surcharges
All daily rental charges exclude petrol. Motorcycles are delivered full, and the hirer shall return the motorcycle full. If the motorcycle is not filled on return, the hirer shall be charged R350.
Excessive Wear & Tear
Fair wear and tear are included in the RENTAL AGREEMENT. THE RENTERS will be responsible for ALL excessive wear and tear. This pertains to, but is not limited to, the following:
1.1 Excessive Tyre Wear – above average tyre usage for the kilometres ridden and in the event of severe tyre and tube damage, like pinch flats from road hazards. THE RENTERS will be responsible for replacement tyres and tubes including fitment charges.
1.2 Paint and Seat Damage – from knee pads, metal boot buckles, rubbing, and scuffing, etc.
1.3 Scuffing – from tie-downs and tank bags. THE RENTERS will be responsible for re-spraying charges.
1.4 Clutch – burnt clutch, burnt brakes from abusive riding, THE RENTERS will be responsible for a full clutch and brake assembly replacement.
1.5 Gears – bad gear choice and additional strain on the gearbox may result in broken and destroyed gearbox; THE RENTERS will be responsible for a full gearbox repair.
1.7 Excessive scratches – other than a few crash bar scuffs, where the crash bars have sustained excessive scratching. THE RENTERS will be responsible for re-spraying charges.
1.8 Chain Drive – where THE RENTERS have not lubricated the chain daily and excessive wear and tear has occurred, chain and sprocket damage other than what is deemed normal wear for the kilometres ridden.
1.9 Scratched crash bars (ZAR450 Repair charge) Bent crash bars, bent brake levers and hand guards, bent pannier racks and badly scratched panniers. THE RENTERS will be responsible for full replacement.
1.10 Dented or badly dented and broken panniers – The rider is responsible for total replacement of broken or badly dented panniers and/or bent mounting racks. Slightly dented panniers will incur a cost of ZAR450.
Traffic fines incurred by renters while riding the rented motorcycle will be deducted from the renter’s credit card and subject to a ZAR250 admin fee over and above the fine amount.
Unforeseen Circumstances
This includes, but is not limited to, war, illnesses, quarantine, extreme weather, riots, or other unexpected events. The consequences of such events are the sole responsibility of the rider. Dare to Live Motorcycle Adventures will not be held accountable for delays, disruptions, or any additional expenses resulting from these circumstances. By agreeing to these terms, you waive any rights to pursue claims against Dare to Live Motorcycle Adventures under South African or international law.
Late Returns
The period of rental of this motorcycle shall be agreed upon on the signature of this agreement, and any late delivery will result in a charge of R250 per hour. There will be a lost key charge of R1500.
Traffic Fines
The hirer shall be held liable for all traffic fines that result from any transgression during the entire rental period mentioned and indemnify Dare to Live Motorcycle Adventures from any liability resulting therefrom.
Dare to Live Motorcycle Adventures retains the right to debit the hirer’s credit card for any fines for traffic offenses received on behalf of the hirer.
Fuel
Motorcycles are hired out with a full tank and must return with a full tank. Charges for refuelling are ZAR350 per motorcycle irrespective of fuel level.
Safety
The hirer agrees not to operate the motorcycle under the influence of alcohol or any illegal or intoxicating substances of any nature and not to behave in any manner that would bring the name of Dare to Live Motorcycle Adventures into disrepute.
Indemnity
The hirer shall use the motorcycle entirely at his/her own risk and agrees that Dare to Live Motorcycle Adventures, its employees, agents, or associates shall not be responsible, liable, or accountable and shall be rendered blameless for any loss, injury, or death sustained as a result of the rental and use of the motorcycle during the rental period or any extension thereof.
Liability
Dare to Live Motorcycle Adventures shall not be responsible and shall be rendered blameless for any loss or damage to goods of any nature left or transported on the motorcycle. The motorcycle will not be used commercially or for financial gain and shall be used purely for personal transportation.
The motorcycle must at all times be used for the purpose that it was manufactured and may not be used for racing or the conveyance of goods, animals, or more than two persons, inclusive of the driver.
Breakdown cover is provided with all rentals. If broken down, contact Dare to Live Motorcycle Adventures immediately and wait for collection/swop-out of your motorcycle. This can take up to 1.5 hours, depending on where in Cape Town you are. Please do not attempt to repair any issue, regardless of your mechanical competency, and ensure that you and your passenger are in a safe location with the motorcycle locked and off-street. If broken down outside of the 100km radius of Cape Town, you will be charged R1500 for recovery.
Additional Per-Km Fees
Additional per-km fees apply @ R6.50 for every extra km over 300km on a single-day rental.
Cancellations
- Bookings cancelled more than 24hrs prior to rental are subject to a 50% cancellation fee.
- Bookings cancelled within a 24hr window of rentals are subject to a 100% booking fee.
- Booking date changes will be subject to availability and may incur extra charges.
